Bobich, also known as Elwood Bobich, as trustee for the heirs and next of kin of Betty Jane Bobich, whose death resulted from an accident allegedly caused by the negligence of Louise Bjork in driving an auto allegedly owned by defendant Frank E. Oja, also known as Ed Oja. Anfred Bjork, special administrator of the estate of said Louise Bjork, was joined as a defendant. Defendant Oja filed a third-party complaint against American Hardware Mutual Insurance Company. The court, Paul A. Lundgren, Judge, ordered summary judgment for said insurance company, and third-party plaintiff appealed from the judgment entered and from an order denying his motion to set aside said judgment to permit him to file a supplementary complaint.
